Terms & Conditions of Trade
- All prices quoted include GST unless they are GST free.
- Cynergex Group Terms are strictly 30 Days - All goods remain the property of CYNERGEX GROUP until payment is made in full. E&OE.
- Cynergex Group reserves the right to apply a monthly interest rate of 0.92% on all overdue amounts after 30 days have passed.
- Oxygen Cylinders: All oxygen cylinders remain the property of the manufacturer. Loss of cylinders incurs a replacement fee of $1,000.00 per cylinder.
- Prices are subject to change without notice.
Returned Goods & Claims Procedure & Warranty Statement
Policy and procedures for the return of goods
- Cynergex Group, via its responsible officers or employees must be notified of any claim for returned goods and/or
adjustments prior to the physical return of such goods. Notification may be via facsimile, email or in writing.
- Cynergex Group personnel are authorised to arrange collection of subject goods and to process claims for credit which
will result in a credit being entered upon the customer's account.
- Such credit is conditional upon the goods being returned being received by Cynergex Group ed claim being physically
returned to CYNERGEX GROUP; and
- goods (other than those the subject of quality complaints) being returned in merchantable condition and may be reversed
or adjusted to the extent' such conditions are not met.
Policy relating to specific types of claims:
- ERRORS ATTRIBUTABLE TO CYNERGEX GROUP PERSONNEL OR ITS CARRIERS Claims, quoting Invoice Numbers, must be
notified within 90 days of invoice
- CUSTOMER ORDERING ERRORS:
Standard Stock Items:
Providing goods are in merchantable condition and the claim is made to CYNERGEX GROUP within 90 days of invoice,
quoting CYNERGEX GROUP Invoice No. CYNERGEX GROUP will accept such goods as returnable, at its' discretion,
CYNERGEX GROUP may apply a 10% handling and freight charge. Goods in this category must not be returned without
a Returned Goods Authorisation being raised and processed as per paragraph 3 above and will not be accepted unless
this is in place.
Pricing Claims:
Claims for credit adjustment based on incorrect pricing of goods must be notified to CYNERGEX GROUP
Customer Service personnel within 90 days of invoice, quoting invoice number.
Goods damaged or lost in transit:
Claims for damage in transit must be notified within 30 days of date of invoice, QUOTING INVOICE NUMBERS. CYNERGEX
GROUP Customer Service may arrange for inspection and (if appropriate) collection of the goods claimed as damaged in
transit PRIOR TO the return of such goods.
Claims for loss in transit must be notified within 30 days of invoice date, QUOTING INVOICE NUMBER OR CUSTOMER
ORDER NUMBER.
Claims regarding allegedly defective products
Claims must be notified within 12 months of invoice or within the recommended shelf life of the product, whichever is
the shorter period. Invoice numbers should be quoted wherever possible. All goods alleged to be defective are subject to
inspection by CYNERGEX GROUP to prove justification of the claim. Where a claim is proven to be unjustified credit will not
be allowed.
Warranty Statement
Customer Rights:
Customers should seek advice on their rights. Any rights implied by statute that cannot be excluded restricted or modified
are not affected by this procedure or by endorsements, on CYNERGEX GROUP goods or packages. Subject to that,
CYNERGEX GROUP'S liability for the goods is limited to claims permitted under this procedure and to any express warranty
given on the goods and liability for consequential loss including loss arising from negligence is hereby excluded. In cases
where it is legally permitted any remaining liability implied by statute is limited to repair or replacement of the goods at CYNERGEX
GROUP'S option.
